Is a Permit Needed for Tree Removal on a Black Mountain Slope?

Sometimes, and slope is what decides it. Kelowna's Tree Protection Bylaw No. 8041 covers trees 100 mm or wider at 1 m above grade on slopes of 30% or more inside a Natural Environment/Hazardous Condition Development Permit Area. Some Black Mountain lots meet that test, so we check the slope and the DP map before quoting. The permit fee is $50.

The City issues these permits for dead, diseased or damaged trees, or where a tree is breaking a roof, retaining wall or sidewalk. The application needs a site plan, the size and position of each protected tree (including any within 2 m of the line on your neighbour's side) and a qualified person's report on erosion, land slip and drainage. That report comes from a registered professional forester, a BC landscape architect or an ISA certified arborist. We don't write it, but we plan the takedown around what it says.

A permit stays good for up to a year, with one extra year possible, which leaves room to book the work for fall. A tree that is actually failing can come down first, as long as you report it to the City straight away. Cutting a protected tree with no permit risks a fine of up to $10,000, and the City counts each tree as a separate offence.

View Pruning Without Topping on Hillside Lots

Up here we get as many calls about views as about hazards. A pine that stood at shoulder height when the house was framed can fill the living-room window decades later. The usual fix is crown thinning, or a reduction cut back to a strong side branch, which opens a sight line while the tree keeps its natural form.

Topping is the shortcut we turn down. It leaves big wounds that let decay in, and the regrowth comes back as weakly attached sprouts that break in the next heavy snow. On a protected tree, Bylaw 8041 treats topping as damage, and so is taking off more than 25% of the live branches in 12 months. If a view tree is too big to thin, taking it out is often the honest answer.

Slope changes how cut limbs come down. We lower wood on ropes so it cannot roll downhill into a fence, a retaining wall or the yard below, and brush stays off the hillside until the chipper reaches it. All our pruning cuts follow the ANSI A300 standard, the same on a 30% grade as on a flat lawn.

Wildfire Risk on the East Side After the 2017 Joe Rich Fire

On August 24, 2017 a fire broke out in the Joe Rich area, about 20 km east of the city, and spread to an estimated 380 ha within a few hours. Evacuation orders went out to 474 properties, about 1,100 people, and Highway 33 was shut from Gallagher to Big White Road. People could see the smoke from just about anywhere in Kelowna.

Black Mountain sits on the same dry mix of ponderosa pine and low grasses that carries fire across the Okanagan hills, and FireSmart BC warns that embers can land up to two kilometres ahead of the flames. The trees nearest the house count most. Our standard is conifers out of the first 10 m, crowns at least 3 m apart from 10 to 30 m, and branches cleared 2 m off the ground.

Most fire work on these lots is small and steady: ladder-fuel saplings under bigger pines, dead lower limbs, and cedar or spruce planted tight to the siding. Can you take down a tree on a steep Black Mountain lot without damaging the slope?

Yes. On steep ground we usually climb the tree and lower each section on a rope through a block, so no log rolls and nothing gouges the bank. The truck and chipper stay on the road or driveway, and brush is carried up to them. Bigger rounds can be left on the slope as firewood if you want them.

Do I need my neighbour's permission to remove a tree near the property line?

For a tree fully on your lot and outside the bylaw area, the City does not need to hear about it. Inside a protected area, a Kelowna permit application has to show protected trees within 2 m of the line on the neighbour's side too. Talk to them before we start, because pieces may be lowered over their yard.

How do I know if a pine on my lot is dying?

Look for pitch tubes, small blobs of resin where beetles have bored in, and a crown fading from green to yellow and red. Western pine beetle attacks ponderosas over 15 cm across, healthy ones included, and carries blue stain fungus into the sapwood. Once the crown turns, the tree is beyond saving.
