Do You Need a Permit to Cut Down a Tree in Peachland?
Sometimes. Peachland is one of the few Okanagan towns whose tree bylaw reaches private yards. Tree Protection Bylaw No. 2404, 2023 applies to all privately owned land, but trees under 150 mm in diameter at breast height, fruit trees, invasive trees and any tree within 1.5 m of a building are exempt. Approved permits cost $50.
The bylaw replaced the old Tree Cutting Bylaw No. 1288 from 1995 and is written with wildfire in mind. Protected trees are a separate, stricter class: anything over 75 cm DBH, heritage trees, trees kept or planted as replacements, trees in a Watercourse or Foreshore Protection Area, and any tree with an active bird nest or an eagle, osprey or heron nest. Applications go to the Bylaw Department, which reviews them with the Fire Department.
Dead, diseased or damaged trees can skip the permit when a qualified professional names them in a letter, and a tree that is an emergency hazard can come down first if it is reported by the end of the next business day. If any part of the trunk base sits on the neighbour's side of the line, the bylaw needs their written consent. Fines run up to $10,000, so we check which category each tree falls into before we quote.
Replacement Trees and FireSmart Setbacks Under Bylaw 2404
Permitted removals in Peachland come with replanting. The owner plants 2 trees for each tree removed, or 6 for each protected tree, within one growing season. Replacement conifers have to be at least 3.0 m tall and deciduous trees at least 80 mm DBH. No replacement is owed for a tree identified as a fire hazard or as dead, diseased or damaged, which covers a lot of the beetle-killed pine we take down.
The bylaw also says where new trees may go: nothing within 1.5 m of a structure, only deciduous trees from 1.5 to 10 m, and at least 3 m between trees from 10 to 30 m. Those are the same three FireSmart BC zones we thin to. Cutting waste must be gone within 14 days, unless the parcel is over one hectare and has an open burning permit, so we chip brush on site and haul or stack the wood the same visit.
Peachland has seen why this matters. A late-season fire in September 2012 burned about 200 ha, destroyed seven buildings and sent 1,500 people out of their homes. Through the District's FireSmart Rebate Program, homeowners can recover 50% of eligible cost up to $1,000 after a free assessment, with labour counted at $32 an hour. Removing Trees on Peachland's Steep Sidehill and Lakeshore
A flat yard gives a faller choices. A Peachland sidehill usually gives one. On many streets the house is often downhill of the tree, so we dismantle from the top with a rope system and lower each section to a landing spot across the slope. A directional felling cut, with a notch and a hinge sized for the lean, only goes in when the drop zone is clear and the slope will not send the log rolling.
Weather here behaves differently from Kelowna. Peachland faces south, which keeps out the cold north winds, but south winds push straight across the lake toward town and can bring wet, lake-effect snow that the steep slope makes worse. Heavy snow on ponderosa pine and interior Douglas-fir is when we see split leaders and broken tops, and those hangers are the first thing we take down on a storm call.
Lakeshore lots bring their own rules. Trees in a Foreshore or Watercourse Protection Area are protected under Bylaw 2404 whatever their size, so waterfront pruning and removals start with a permit question. Higher up, near the Drought Hill interchange where Highway 97C begins, larger parcels still carry dense pine and fir that suit land clearing and thinning rather than one-tree jobs.

Is a small tree on my Peachland lot protected?
Usually not. Bylaw No. 2404 exempts trees under 150 mm DBH, measured at breast height, so most young ornamentals and saplings can come out without paperwork. The exceptions are small trees that were planted as replacements, trees in a foreshore or watercourse area, and any tree holding an active nest. Those still need a permit.
